Conditions of Sale
1. Participating in an Auction
By bidding at auction, you agree that these Conditions of Sale, as modified by any additional notices or terms published on our website, are your entire agreement with “Auc.Kingdom” (the “Site” or “we” or “AK”) and that they govern all bidders.
2. Registering to Bid
If you are not already a registered AK bidder, you must register online at AK URL. Bidders from overseas may be required to present a valid ID for identification purposes. To bid, you must next accept the Conditions of Sale and the Terms of Use. You may then place bids once the auction has opened. You agree that all bids that you submit are final and irrevocable.
AK reserves the right, in its sole discretion, to refuse your participation before, during, or after the sale.
3. Reserve Price (Currently not set.)
All lots have a minimum bid designated in the catalog and the on-line listing. Certain lots may also have a reserve, which is the confidential price below which the lot will not be sold. The reserve may be greater than the minimum bid. If the bidding does not meet the reserve at the close of the auction, Auction hours will be extended.
4. Bidding
The bidder who places the highest bid accepted by AK will be the purchaser of the lot. AK has absolute discretion in all matters relating to bidding, including, but not limited to, identifying the winning bidder, handling mistakes or errors in bidding, re-opening bidding, canceling the sale, and re-offering the property for sale.
5. Popcorn Bidding
Popcorn Bidding, also known as Dynamic Bidding, is a way of giving the bidders who were outbid an opportunity to rebid.
You will have another opportunity to bid within approximately 5 minutes of last bid.
6. Proxy Bidding
Proxy Bidding is a concept in which the system automatically bids on your behalf up to the maximum bid amount that you have chosen. This is simple to make the online auction process much easier and less time-consuming.
7. Postponement; Withdrawal
AK reserves the right to postpone any auction or withdraw any lot before, during, or after the sale; we shall have no liability whatsoever for such withdrawal. AK may also, in its sole discretion, extend the closing time for any Lot.
8. Bidders
By participating in the sale, you represent, warrant, and agree that:
Neither you individually nor—if “you” are a company or other entity—any person who owns, partly owns, or controls the company or entity, are subject to trade sanctions, embargoes, or any other restriction on trade in the jurisdiction in which you or it does business, as well as under the laws of the European Union, the laws of England and Wales, or the laws and regulations of the United States (collectively, “Sanctioned Person(s)”);None of the purchase price will be funded by any Sanctioned Person(s), nor will any party involved in the transaction, including, but not limited to, financial institutions, freight forwarders or other forwarding agents, or any other party, be a Sanctioned Person(s), nor owned (in whole or in part) by a Sanctioned Person(s), nor controlled by a Sanctioned Person(s), unless such activity is authorized in writing by the government authority having jurisdiction over the transaction or in applicable law or regulation; andYou are financially sound and know when and how you will pay for the lot if you are the winning bidder.
9. Winning Bidder’s Obligations
Subject only to these Conditions of Sale, the closing of the lot establishes a binding contract and the winning bidder. AK will email an invoice in the name of, and with the address registered for the bid, to the winning bidder, which cannot be transferred to other accounts, names, or addresses without AK’s explicit agreement in writing.
・Payment
Unless otherwise agreed by AK in writing, the winning bidder must pay the full price invoiced (including buyer’s premium, applicable tax, and other amounts due), so that it is received by AK in good, cleared funds within 3 days of the close of the auction.
In the event payment has not been made within 3 days of the close of the auction, The right to purchase is passed to the next successful bidder. In addition, you may be restricted from bidding in the future.
・TAX
Import duties, taxes and charges are not included in the item price or shipping charges. These charges are the buyer's responsibility.
Please check with your country's customs office to determine what these additional costs will be prior to bidding/buying.
These charges are normally collected by the delivering freight (shipping) company or when you pick the item up - do not confuse them for additional shipping charges.
10. Resolving Disputes
We hope never to have any disputes with you but, if we do, we will first try to resolve it amicably if we (in our sole discretion) believe that we reasonably can. If we do not resolve the dispute, this section contains the important terms to which you and other bidders agree by participating in the auction.
・Limitation of Liability
Under no circumstances shall the aggregate liability of AK to a purchaser exceed the purchase price actually paid. AK will not be liable for any errors or failures to execute bids or for any errors or failures caused by (i) a loss of connection to the internet or to AK’s online platform or website by either AK or a bidder; (ii) a breakdown or problem with AK’s online platform software or website; or (iii) a breakdown or problem with a bidder’s Internet connection, mobile network or computer.
